Acceptance of Terms
ContentScaler is operated by Orqua Technology GmbH, Oberbrunnernstraße 15/4, 4522 Sierning, Austria, registered in the commercial register under FN 680129 s. By accessing this website, requesting access, or using ContentScaler services, you agree to these Terms of Service. If you act for an organization, you confirm that you are authorized to bind that organization.
Description of Services
ContentScaler provides AI-supported tools for content research, generation, quality checks, optimization, publishing workflows, integrations, and related services. The exact scope depends on the plan, invite status, beta or pre-launch availability, and any separate agreement with us.
User Accounts
You must provide accurate account and contact information, protect your credentials, and remain responsible for activity under your account. You must promptly notify us of suspected unauthorized access. We may refuse, suspend, or terminate access if information is inaccurate, security is at risk, or these terms are violated.
Plans, Credits and Availability
Plans, included credits, feature limits, and credit packages may change as the product evolves. During invite-only, beta, or pre-launch phases, features may be incomplete, changed, paused, or withdrawn. We will make reasonable efforts to communicate material changes that affect paid customers.
Payment Terms
Paid subscriptions are billed in advance on the billing cycle shown at checkout or in the applicable order. Credit packages are billed at purchase. Prices may exclude taxes unless stated otherwise. Refunds are only provided where required by law or expressly agreed in writing.
Content Ownership
You retain ownership of content, source materials, prompts, brand materials, and outputs you submit or generate, subject to third-party rights and applicable law. You grant us the rights necessary to host, process, transmit, transform, store, and display that content solely to provide, secure, support, and improve the services.
AI Outputs and Review
AI-generated output can be inaccurate, incomplete, similar to third-party material, or unsuitable for a specific legal, medical, financial, or regulated use. You are responsible for reviewing, editing, fact-checking, and approving content before publication. ContentScaler does not replace professional judgment.
Acceptable Use
You may not use the services for unlawful, deceptive, harmful, abusive, infringing, privacy-invasive, security-compromising, spam, malware, or rights-violating activities. You may not bypass technical limits, reverse engineer non-public parts of the service, overload infrastructure, or use outputs in a way that violates applicable platform, advertising, consumer protection, or intellectual-property rules.
Third-Party Services
ContentScaler may integrate with hosting providers, AI providers, payment providers, CMS platforms, social networks, analytics tools, and other third-party services. Your use of those services may be subject to their own terms and availability. We are not responsible for third-party systems outside our control.
Confidentiality
If either party receives non-public business, technical, pricing, security, product, or customer information from the other party, it must use reasonable care to protect that information and use it only for the purpose for which it was provided, unless disclosure is required by law.
Suspension and Termination
You may stop using the services at any time. We may suspend or terminate access if you breach these terms, create security or legal risk, fail to pay amounts due, or misuse the services. After termination, we may retain data as required or permitted by law and our Privacy Policy.
Limitation of Liability
To the maximum extent permitted by law, Orqua Technology GmbH is not liable for indirect, incidental, special, consequential, or lost-profit damages. Our aggregate liability is limited to the amounts paid by you for the services in the twelve months before the event giving rise to the claim. This limitation does not apply where liability cannot lawfully be limited, including intent, gross negligence, injury to life, body, or health, or mandatory consumer rights.
Governing Law
These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected where they apply.
Changes to Terms
We may update these terms to reflect product, legal, security, or business changes. For material changes affecting active customers, we will provide reasonable notice through the website, application, or email. Continued use after the effective date means you accept the updated terms.
